What Documentation is Needed for a Work Permit in Canada?

Work permits grant qualified and prepared applicants entry into Canada to work in various sectors that involve specific skill sets. To qualify, there are several requirements you must generally meet:

  • You must qualify under the conditions of CUSMA, the International Experience Class, or obtain an LMIA assessment
  • Possess the necessary skills and experience
  • Have proof that you are only coming to work in Canada temporarily
  • Obtain a valid offer of employment
  • Clear medical and background checks
  • And possibly more

In some cases, you may also need to pass an interview with a Canadian immigration services agent. At Border Solutions Law Group, our Canadian work permit lawyers can prepare you for explaining your work history and ensure your responses align with the online documentation that Immigration, Refugees and Citizenship Canada (IRCC) will review.

The Application Process for Work Permits in Canada

Many people may not know this, but Canada has a more complex work permit application procedure than the U.S. Applications are usually submitted online through the IRCC’s web portal. Most foreign nationals need either an employer-specific work permit or an open work permit, depending on their situation and the program they qualify under.

The first step is usually to confirm whether you actually need a work permit and, if so, which type applies. IRCC provides an online tool to help you find out if you need a work permit and whether your situation calls for an employer-specific or open permit.

In British Columbia, some workers may be eligible to enter Canada through economic immigration routes such as the BC Provincial Nominee Program (BC PNP), which can be part of a longer term plan for Canadian permanent residence.

Next, you must gather the supporting documents required for your category. As detailed above, this often includes:

  • A valid job offer
  • a Labour Market Impact Assessment (LMIA), if one is required
  • Proof of your work experience or education
  • A copy of your passport
  • Evidence that you will respect the conditions of your stay
  • And possibly more.

Depending on your case, you may also need to complete medical examinations and provide biometrics.

You then complete the online forms, upload your documents, and pay the required government fees through your secure IRCC account. Applications can be filed from outside Canada or from within Canada if you meet the eligibility rules for applying from inside Canada. After submission, IRCC may ask for additional information, and most applicants must provide biometrics before a final decision is made. Processing times and requirements can change, which is why it is important to follow the official instructions closely.

There may be specialized work permit options available to you, such as Post-Graduation Work Permits and Bridging Open Work Permits, each with its own rules and timelines.

Navigating these options can be confusing. Our Canadian work permit lawyers at Border Solutions know this process inside and out. Our goal is to make sure you only go through the process once and to make sure your immigration journey proceeds as seamlessly as possible.
